The EPA has yet to announce how it will handle more
than 50 so-called “gap year” small refinery exemption requests.
American Coalition for Ethanol CEO Brian Jennings says it should be clear based on the 10th Circuit Court ruling earlier this year that these petitions be denied.
“It appears EPA has been busy trying to help these refiners figure out sort of how to rewrite history and retroactively string together a number of these waivers.”
EPA Administrator Andrew Wheeler has acknowledged several issues surrounding the gap year requests, but says he’s waiting on the Department of Energy’s review before making a final decision.
