Two groups have gone to back court to prevent sulfoxaflor from being used. The Center for Food Safety and the Center for Biological Diversity filed a brief with the 9th Circuit Court of Appeals in California this week saying EPA failed to consider endangered and threatened species when approving the insecticide.
Sulfoxaflor use started in 2013, but the court stopped its use because EPA didn’t assess the chemical’s impact on bees. It was approved again in July of 2019, and opponents have been back in court trying to stop it since. The EPA wants to allow continued use while they conduct an endangered species review, estimated to take seven years.
