A federal appeals court has granted the emergency motion filed by the Renewable Fuels Association in response to the EPA’s last-minute granting of three small refinery waivers.

The RFA says the US Court of Appeals for the D.C. District has ordered EPA’s actions on Tuesday to be “administratively stayed” until further court order.

The action prevents the EPA from processing the small refinery exemptions it approved late Tuesday of two  waiver petitions for 2019 and one for 2018.
